INTERNET PREMIUM
An Internet Premium of 15% will be added to your high bid and will be part of the final sales price. **All vehicles must be paid for in cash or certified check. We do not accept credit card payment on any items that require titles. Titles will be mailed within 10 days of payment and auction close.

WARRANTY
The real estate is being sold “AS IS, WHERE IS” with no warranty expressed or implied by the seller or auctioneer. The seller has provided descriptions of items for sale that are that are believed to be correct, however, neither the seller nor the auctioneer guarantee the accuracy or correctness of any description. An on-site inspection time will be provided and the auctioneer recommends inspections be performed. Your failure to conduct inspections prior to bidding does not relieve you of your responsibility to do so in anyway. No claims for refund, price adjustment or withdraw of a bid will be considered. As a bidder, you will determine the value, condition, age, authenticity, rarity or construction materials of the goods offered for bid. All transactions are between the seller and the buyer; the auctioneer acts only as an agent.
BIDDING
This is an online timed auction. All bids for this auction must be placed online via the Internet through our bidding platform. You will place a bid, which will be considered your maximum bid. The system will then put your bid at the level required to make you the high bidder. As others bid your bid will be increased in pre-set intervals until you win the bid at the close of the auction or until your maximum bid is exceeded and you are out of the bidding. You may re-enter the bidding at any time if you are outbid. The opening and closing dates and times of the auction are posted at the end of the Terms and Conditions. The auctioneer reserves the right to extend bidding on any item that receives a bid in the final five minutes of the auction. Extended bidding will continue until bidding on that item ceases.
The auctioneer is held harmless in the event of computer, software, hardware or server malfunctions, or down at any time during this auction event.
FIREARMS
When applicable, State Sales Tax, Property Tax, State Registration Fees on vehicles will not be charged by the auctioneer and are the responsibility of the buyer to pay the appropriate government agency. Any firearms sold by The Swicegood Group, Inc. will be picked up at a designated federal firearms licensed dealer. Working condition of firearms is to be determined by the purchaser. To purchase a firearm, you must be (21 yrs.) twenty-one years old, a resident of North Carolina, complete a Federal Firearms Application form and have in your possession a valid North Carolina driver’s license. Under no circumstances will firearms be shipped. The firearms for this sale are being held at an FFL registered dealer, Davie Outfitters (336-751-1733) located at 661 Wilkesboro St Mocksville, NC 27028.
PAYMENT
Your payment method will be pre-determined when you register. You will pay by credit card; Visa & MasterCard only. Your credit card number will be on file and the full amount of your purchases including the buyer's premium and sales tax, if applicable, will be charged to your account within (2) two hours of the close of the auction. Your acceptance to the Term and Conditions set forth herein includes your agreement not to initiate a chargeback on your credit card. A declined credit card will result in a ($30) thirty-dollar processing fee to use a different card or to process a check.
REMOVAL
**AUCTION COMPANY DOES NOT LIFT, LOAD, PACK, OR SHIP**

If any buyer requests special pick up times or instructions, there will be a $25.00 per hour (1 hour min.) charge to your credit card per event to cover costs of staffing. If after making special arrangements to pick up your item(s) in person and those items are not picked up as arranged, you have forfeited that item(s). Payment will not be refunded.

MOVING, DECONSTRUCTION AND UNINSTALLING
Deconstruction of structural purchases including, cabinetry, flooring, framing, sheeting, windows, doors, fireplaces, appliances or any other such purchases are solely the responsibility of the buyer. All labor, loading, equipment, tools or vehicles required to deconstruct will be provided by the buyer. Uninstalling of fixtures, plumbing, electrical appliances, lighting, built-ins, specialty equipment or any other such purchases are the responsibility of the buyer to remove. The buyer will provide all labor, loading, equipment, tools, or vehicles required to remove all purchases. The buyer is responsible for safety of personnel used to remove or deconstruct and the safety of others picking up goods in the same area. The buyer will be held responsible for any unnecessary damages done to the property resulting from the removal process. In the event that an item that requires Deconstruction or Uninstalling is not picked up, that item will be forfeited.
Soft Close Defined: Online Auctions with The Swicegood Group, Inc. are timed events and all bidding will begin to close at a specified time. This format simulates a LIVE auction event. The bidding platform has an auto-extend feature which means, any bid placed in the final five (5) minutes of an auction will automatically extend the bidding for an additional five (5) minutes from the time the bid was placed. For example, if an auction is scheduled to close at 6:00 and a bid is received at 5:56+, the close time will automatically extend for another 5-minute increment. The auto-extend feature will continue until there is a five (5) minute period without any new bids being placed by bidders. After the 5-minute “quiet period” expires, the auction will automatically close.
