Terms & Conditions - 27.339 Acres - Holly Springs Rd. East Bend, NC 27018


A 10% buyer's premium will be applied to the high bid to derive the contract sales price. Firm is the agent of the Seller of the Property offered for sale by auction, and Broker and Seller have agreed that this sale is to be conducted by including a buyer's premium of upon the final high bid price as determined by the Broker ("Buyer's Premium"). The actual contract sale price shall be the sum of the successful high bid plus the Buyer's Premium.

By registering, bidder acknowledges that they desire to bid upon said Property.

Bidding: Bid price is a "per acre" price for entirety of property. Sale price will be figured by multiplying bid price by acreage stated on county tax card, unless a buyer provided survey is conducted, in which case the survey acreage will be used.

Easements: Subject to all easements recorded or unrecorded. If Buyer elects to have a survey it will be at Buyer’s expense.

Zoning: Subject to all state and local zoning ordinances.

Agency: Auctioneer/Broker represent the sole and exclusive interests of the Seller alone.

Settlement: Closing will occur within thirty (30) days of contract execution. A twenty percent (20%) non-refundable deposit is due within 24 hours of contract execution. Deposit will be held in trust by Seller's attorney and credited to buyer at closing.

Taxes/Dues: Buyer to pay real estate taxes and any dues/fees as applicable on a prorated basis for the calendar year of 2018.

Closing Costs: Buyer will pay all customary buyer side real estate closing costs including but not limited to, recording of the deed, title examination fees, title insurance cost, attorney fees, survey, inspections, HOA dues, Fees, insurance if applicable, etc.

Warranties: Property is being sold in “AS, IS, WHERE IS” condition with no warranties and is subject to all the applicable Federal, State, and County laws, regulations, and ordinances and is also subject to all plats, all current proposed or pending covenants, restrictions, zoning, government requirements, environmental issues, roadways, easements, and rights-of-way of record.

Auction Type: Property is being sold subject to reserve price.

Auction Ending/Soft Close: Online Auctions are timed events and all bidding will begin to close at a specified time. There is an auto-extend feature, which means that any bid placed in the final five (5) minutes of an auction will automatically extended from the time the bid was placed. For example, if an auction is scheduled to close at 6:00 and a bid is received at 5:56+, the close time will automatically extend. The auto-extend feature will continue until there is a five (5) minute “quiet” period in which no new bids have been received, the auction will then close.

Bidder Responsibilities: Bidder agrees to keep their username and password confidential, as they are responsible for ALL activity involving their account.
