You acknowledge and give consent to the auctioneer to communicate via e-mail to the address(es) provided and that you have authorization to provide consent for e-mail to the e-mail address(es) that you provided, and further agree to indemnify and hold harmless the auctioneer for any action or loss arising from any incorrect or false e-mail address(es) provided. You may revoke this email authorization by notifying the auctioneer of such revocation.
The auctioneer is acting as agent only to the seller and is not responsible for the acts of its principles.
All announcements made at any time and through any platform shall take precedence over previously distributed information.
All lots will be sold to the highest bidder conforming to the Terms & Conditions.  The auctioneer reserves the right to sell on behalf of third parties, its own account or on the account of others. The auctioneer shall regulate all matters relating to the conduct of the auction and any decision made by auctioneer shall be final and binding on all bidders. The auctioneer shall at all times be entitled to make changes in the composition of the lots or to withdraw any lot, up until the last moment before the sale. Auctioneer may refuse bids without having to state the reasons, in which case the previous bidders shall be bound to their bids.
The auctioneer reserves the right to sell subject to reserve and to purchase for its own account and/or for the account of others, whether by verbal or written proxy, all subject to prior sale.
The auctioneer reserves the right to correct any mistakes or typographical errors made in any of the announcements, documents, online descriptions or any information disseminated.

All sales shall be concluded on the fall of the hammer which is identified as a digital ending of the auction or as indicated by the auctioneer and no purchaser may thereafter revoke his bid. Title to the lots purchased shall not pass until payment in full of the purchase price is received.

No purchaser may assign, transfer or dispose of his rights in any article purchased before he has paid the purchase price in full.
The auctioneer is held harmless in the event of computer, software, hardware or server malfunctions, that may go down at any time during this auction event.
If the auctioneer is unable to deliver an article sold to a purchaser due to fire, theft, or any other reason whatsoever, the auctioneer shall reimburse the purchaser for all monies paid to the auctioneer in respect to the article and the auctioneer shall have no further liability to the purchaser arising from or relating to such loss, including without limitation, any damages for loss of profits.
Where available, documents of transfer, including motor vehicle ownership documents, if any which are in the possession of the auctioneer, will be provided to the purchaser within 7 days following the auction or as soon thereafter as such documents are available.
The auctioneer reserves the right to refuse any applicant the privilege of bidding at the auction and may revoke such privilege at any time.
This sales transaction shall be governed by and construed in accordance with the local laws of the state of North Carolina, USA. The venue for trial or resolution of any dispute arising out of or related to this transaction shall be the North Carolina State Courts sitting in Davie County, North Carolina, USA. If any provision of these terms and conditions shall be held invalid, illegal, unenforceable or inoperative, the balance of the terms & conditions shall remain in full force and effect as if such provisions had not been included.
The buyer hereby assumes and does agree to indemnify and hold the auctioneer and seller harmless from any current or future claim which shall pertain to the fitness, use, damage, safety, injuries to persons or property that may have been caused by or during removal or use of item(s) purchased, or any other claim regarding the use of that asset as purchased. All buyers acknowledge and accept these terms by registering.
PAYMENT TERMS
All payments shall be by way of cash (US Dollars), credit card (Visa, Master Card, Discover), certified check from an approved bank, or wire transfer. All bidding and invoicing will be in US Dollars. All invoices must be checked on the day of the sale as no adjustments will be made thereafter.

PICK-UP TERMS

All transactions will be charged immediately following the auction using the credit card on file (given at the time of registration) UNLESS the invoice is over $2,000.01. Bidders with invoices over $2,000.01 will be paid by certified check from a national bank. Checks need to be sent within 24 hours after the end of the Auction. If payment is not received, The Swicegood Group, Inc. will attempt to collect by charging the credit card on file for the full amount or any amount less than the purchase price. No item will be released until satisfactory U.S. funds have been received. The purchaser shall be responsible for all costs of removal and shall be liable for any damage, including without limitation, any environmental damage, caused during or as a result of the removal. Purchasers shall comply with all environmental laws and regulations and all requirements established by the auctioneer for the removal of articles, including requirements as to bonding of movers.
Time will be of the essence. If a purchaser fails to make payment or remove goods within the time periods announced by the auctioneer will charge the buyer's credit card on file a penalty of 1.10% of the invoiced amount and may resell the article at the auctioneer's sole discretion. The purchaser shall be liable for the shortfall and all costs and expenses, including but not limited to interest rates (a minimum of 1.5% per month or 18% per annum), legal fees, moving and storage (a minimum rate of $2.75/sq ft per month) and commissions, incurred in such resale.
Purchases that are not removed within the designed time will be considered abandoned.
The auctioneer does not pack, ship, crate, transport or rig items. A list of riggers will be provided for you, however, this is not an endorsement of any of their services. Buyers may pick up their items at the auction site personally or can arrange for a third-party logistics firm to manage the removal for them. We do not make representations or warranties of any kind whatsoever.

Rigging/Removal of sold items is the sole responsibility of the buyer and must be completed by the end of the checkout period. Rigging/Removal may not begin until payment has been made in full and the auction sale is complete. All heavy rigging requiring the use of forklifts, cranes, etc whether performed by the customer or a rigging company, must present a certificate of insurance for $1,000,000.00 naming The Swicegood Group, Inc. as the insured.
Recommendation or approval of Riggers by the auctioneer by any employee, agent, or affiliated entity of the auction company shall be done only as an accommodation to the buyer. Such recommendation or approval shall not cause the auctioneer to be liable in any way for any act or omission of any such Rigger. Selection of a Rigger is solely within the discretion of the buyer, and the buyer acknowledges and agrees that it shall have no rights or remedies against the auction company or any of their representatives/affiliates.
** These terms and conditions with any amendments or modifications expressly made by the auctioneer at the time of the auction constitute all the terms and conditions with respect to the sale of articles at this auction. There are no representations, warranties, terms, conditions, undertakings or collateral agreements except as hereinabove provided.

Everything in the lot must be removed or your card will be charged a clean-out fee penalty. Any items left after the designated pickup date will be forfeited unless prior arrangements have been made.

Registration requires a valid credit card to confirm your identity. A confirmation that you have at least $100 will be required. WE DO NOT charge for registration. This card will only be charged if you are a winning bidder on any item(s).

Payments are made by Visa, Mastercard, and Discover only unless prior arrangements have been made with the Auctioneer. THERE WILL BE A $25.00 CHARGE ON ALL DECLINED CREDIT CARDS.

All shipping arrangements are the sole responsibility of the Buyer. Please research your shipping options before bidding on the items. Also, please be aware of the scheduled pick-up dates/times and plan accordingly.

The auction company is not responsible for lifting, loading, packing, or shipping. Please make sure you bring enough help/supplies to assist in the packaging and loading of your items. Any items left after the day designated, as “checkout” will be considered abandoned and all rights will be forfeited. Please be aware of the scheduled check-out date and time.

Staggered End Time: Multiple lots will close each minute so the auction ending is staggered to allow for this to occur.

Soft Close Ending: Lots may remain open for bidding if bids are placed in the last minutes before that lot closes. Lots will close once competitive bidding has ended.

Conditions: All information contained herein is deemed to be from reliable sources. However, neither the Auctioneer nor the Seller guarantees this information to be correct. We reserve the right to add or delete. Please inspect the property and bid accordingly. By bidding, you, the Bidder/Buyer, certify that you have either closely examined the item(s), have chosen to not examine the item(s), or have hired an independent agent to examine the item(s)for you. The Auctioneer represents the Seller in this transaction. All announcements made online or via any communication medium shall take precedence over all other information.

Purchases become the responsibility of and shall be, and remain at the risk of the purchaser immediately upon acceptance of his/her bid. It shall be the responsibility of the purchaser to obtain insurance for their purchases immediately if applicable.

No sale shall be invalidated because of any defect or inaccuracy in any of the lots because of their being incorrectly described in the listing or elsewhere and no liability shall be borne by the Auctioneers in respect of any such fault or errors. This listing has been prepared only as a guide based on information from sources generally believed to be reliable, but the accuracy thereof cannot be guaranteed or warranted by the Auctioneers. Bidder acknowledges that it is their responsibility to inspect all items and to make his/her own inquiries.

There are no guarantees or warranties, expressed or implied, statutory or otherwise of any nature whatsoever by the Auction Company. Bidder agrees that everything is sold "AS IS, WHERE IS" and that they may not return any item purchased. The property being sold may be either New or Used. We make no representation or warranty for any of the lots, which are the subject of the auction.

This listing with pictures/descriptions is only a guide, therefore, please inspect the item(s) prior to bidding. All sales are final. We reserve the right to put a hold on your account for an amount up to the amount of your bid prior to the end of the auction.

Bidders who bid understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the bidder's responsibility to determine condition, age, genuineness, value, or any other determinative factor. The auction company shall endeavor to describe in detail each item and any pertinent information about it, however, we will not be responsible for any error or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself.

The auction company reserves the right to refuse service to any person. The Swicegood Group, Inc. does not preclude the right of any employee, subcontractor, or shareholder to bid on any item.

The Swicegood Group, Inc., sells to international online buyers via our online auctions. It is our policy to require a $1,000.00 deposit in order to bid from another country. This is immediately refundable if you do not purchase any items and will be applied towards your balance if you are a successful purchaser.

We will not be responsible for lifting, loading, packaging, or shipping. Please make sure you bring enough help/supplies with you to pick up. WE WILL NOT LOAD ANY ITEMS - THIS IS THE BUYER'S RESPONSIBILITY.
